NEW YORK – U.S. Immigration and Customs Enforcement (ICE) Enforcement Removing Operations (ERO) officers took custody of Fernando Olea-Prado, 25, a self-described chief of the Sureños (Sur 13) road gang, in Corona, New York, Oct. 1.

ICE beforehand eliminated Olea-Prado, who illegally entered the U.S. at an undetermined time and site, on two separate events in August 2013.

On Sept. 11, 2020, New York Police Division arrested and charged Olea-Prado, an unlawfully current Mexican nationwide, with three counts of theft, assault, legal possession of a weapon, and legal possession of stolen property.

After his most up-to-date arrest, Olea-Prado had been launched from native legislation enforcement custody regardless of being the topic of an energetic ICE detainer. Native legislation enforcement businesses routinely fail to honor ICE detainers as a matter of coverage, which was adopted by the native metropolis authorities.

“The place is the priority for the security of the residents that these native politicians had been elected to guard?” asks Thomas R. Decker, ERO New York discipline workplace director. “It’s reprehensible that native politicians handed a legislation that permits a twice-removed, violent road gang member to be launched from custody to commit extra violence on this metropolis.”

Decker went on to counsel that New York’s sanctuary metropolis insurance policies, which bar native legislation enforcement businesses from cooperating with ICE’s immigration enforcement actions, underscore the significance of ICE’s public security mission.

“When you will have a legal alien, like Olea-Prado, who flouts U.S. immigration legal guidelines, coupled together with his gang membership, and the secure haven granted by native politicians, it creates a harmful state of affairs for New York Metropolis residents,” stated Decker. “That’s why ICE officers should proceed eradicating violent criminals like Olea-Prado.”

Olea-Prado will stay in ICE custody pending the end result of his removing proceedings earlier than an immigration choose.

    About Detainers

ICE depends on the trade of knowledge with its legislation enforcement company companions to entry foreign-born inmates at native, state, and federal services, and using detainers as a part of its public security mission. In lots of instances, these people pose a demonstrable menace to communities.

By lodging detainers in opposition to these people, ICE makes each effort to make sure that detachable aliens are turned over to ICE custody after their legal detention relatively than being launched into the neighborhood the place many abscond or re-offend.

ICE just lately launched a quarterly declined detainer report to boost consciousness of the kind of harmful criminals launched in New York and communities across the nation.

The report explains that ICE is congressionally mandated to take away legal aliens from the U.S. and that public security is jeopardized when native governments prohibit legislation enforcement businesses from honoring ICE detainers. These native insurance policies, the report explains, power ICE to extend its presence in native communities.
